Halle Berry's custody dispute with ex-husband Olivier Martinez heads back to court Oct. 16, as her 18-year-old daughter, Nahla Aubry, has publicly defended her in a sworn declaration. Nothing has been proven, and the temporary orders now in place are not a ruling on the allegations.

Martinez, 60, alleges that Berry, 60, physically abused their 13-year-old son, Maceo, during a Sept. 26 incident, and he is asking for sole custody. Berry denies the claims. On Oct. 1, a Los Angeles County judge granted a temporary restraining order that limits Berry to court-ordered visitation and requires her to stay 100 yards from Martinez until the hearing, according to CBC News and TMZ.

In her declaration, Nahla said she has never seen her mother physically abuse Maceo, calling the allegations "completely inconsistent with the mom I know." She described Berry as a devoted, involved parent and disputed other claims in Martinez's filing.

Berry has asked the court to restore the 50/50 custody agreement set in 2023, and reports say she is also seeking to reinstate her tie-breaking authority and require Martinez to attend court-ordered therapy. Martinez has asked the court to deny her requests and has told PEOPLE his actions were motivated by concern for his son's welfare.

The judge is expected to decide whether the temporary restrictions stay in place or change. Until then, the order remains a short-term safeguard, not a final decision.
